Deferred Fees

Extended payment terms may be available for approved matters

For some proceedings, OCA Law may agree to defer collection of professional fees until a defined Deferred Payment Date. This is an extended payment arrangement, not a “no win no fee” arrangement — the underlying liability for properly incurred legal costs is not conditional on success.

Monthly invoices continue to be issued. Interest may accrue on unpaid legal costs in accordance with the Costs Agreement and applicable law, at the rate stated on the relevant invoice. Approved arrangements require security, which may involve an equitable charge over property and a caveat protecting that security — the caveat does not itself create the security, and does not determine whether a disputed amount is payable.

The Deferred Payment Date is the earliest of several defined events (for example settlement, judgment, termination of the retainer, or sale or refinancing of the secured property) — not simply the final end of a case. Because OCA Law has its own financial interest in any security granted in its favour, independent legal advice is recommended before signing. Disbursements and third-party outlays are not deferred and remain payable within ordinary invoice terms.

In short:

  • No application, establishment or drawdown fee
  • Security and eligibility criteria apply
  • Early payment is available at any time, without penalty
  • Independent legal advice is recommended
